These Terms of Service ("Terms") govern your use of the HITS mobile application and related services (collectively, the "App") operated by HITS ("we," "us," or "our").
By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App. Questions? Email us at howistheset@gmail.com.
You must be at least 13 years old to use HITS. By using the App, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at howistheset@gmail.com if you suspect unauthorized access.
Fan accounts are free. You can browse gigs, filter by genre or date, view gig details, and save shows to your profile. No payment information is required.
You may browse the Discover feed and map without creating an account. Guest users cannot save gigs or access profile features.
Posting gigs on HITS requires an artist account, which is available for $5.00 per month. The subscription is billed monthly through the Apple App Store or Google Play Store.
We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price increase takes effect. Early adopters who subscribed before any price increase will be notified directly.
HITS takes 0% commission on ticket sales or revenue you earn from your shows. The $5/month subscription is the only fee we charge artists.
You retain ownership of any content you post to HITS (gig listings, bio text, profile information). By posting content, you grant us a non-exclusive, royalty-free license to display that content within the App to other users.
As an artist, you are responsible for ensuring the gig information you post — venue, address, date, time — is accurate. Posting false or misleading gig information may result in account suspension.

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful to the community or the App's integrity.
The HITS name, logo, design, and all App code are owned by us and protected by applicable intellectual property law. You may not use our branding or copy our App without written permission.
The App is licensed to you, not sold. Your license to use the App is personal, non-transferable, and subject to these Terms.
HITS is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that gig information posted by artists is accurate, complete, or up to date. We are not responsible for cancelled shows, incorrect venue information, or any experience resulting from attending a show you found through the App.
We do not guarantee uninterrupted or error-free operation of the App. We may modify, suspend, or discontinue the App at any time without liability.
To the fullest extent permitted by law, HITS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App — including but not limited to attending a show found through the App, loss of data, or unauthorized access to your account.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from the Profile screen in the App. Upon termination, your right to use the App ends immediately.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Philadelphia County, Pennsylvania.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
